Terms of Service
Effective
These terms apply when you play Paradise Puzzles, made by Jamie Parnaby, trading as Obsidaby (“we”, “us”). By playing, you agree to them; if you don't agree, please don't play. You also agree to the terms of the store you got the game from:
- App Store (iPhone and iPad): Apple's Licensed Application End User License Agreement is the licence for the app, and the Apple Media Services Terms cover buying from Apple.
- Google Play (Android): the Google Play Terms of Service cover the download and buying from Google.
These terms add the rules of the game itself. If they conflict with your store's terms, the store's terms apply.
Who can play
Paradise Puzzles includes simulated gambling and is rated 18+ on the App Store. The slots, the shop and raids are only for players aged 18 or older. The game checks your age the first time you play, and keeps them locked for anyone under 18; you must answer truthfully. Puzzles and building your island are open to everyone who may use the game under their store's rules.
Your licence to play
We give you a personal, non-exclusive, non-transferable licence to use the game for your own entertainment, on devices you own or control, under these terms and your store's terms. The game, its art, music, characters (including Mango), names and logos belong to us or our licensors, and you may not copy, sell or reverse-engineer them except where the law allows.
Simulated gambling
The Slots and other chance-based features use in-game spins and pay out in-game items only. The Slots never pay out spins. You can't wager real money, and nothing you win can be cashed out, sold or exchanged for money or anything of value outside the game. The odds of each prize are shown in the game before you spin.
In-game currency and items
- Coins, gems, spins, shields, boosters and other in-game items are part of your licence to play. They aren't your property, have no cash value, and can only change hands through supported game actions such as raids. They cannot be sold or traded outside the game.
- We may change, rebalance or remove in-game items, prices and features to keep the game fair and fun. We'll avoid taking away anything you've paid for without a fair replacement, unless the law requires it or you've broken these terms.
Purchases and refunds
- You can buy gems, coins, spins, boosters and other in-game items in the shop. The store you got the game from (Apple or Google) sells them to you and takes the payment under its own terms, and shows the price in your currency before you buy.
- Bought items are added to your game account as soon as our server confirms the purchase with the store. If one doesn't arrive, reopen the game while online; if it still hasn't arrived, contact us.
- Bought items are part of the licence described above. They have no cash value, can't be exchanged for money and are used up when you spend them. Some offers can only be bought once.
- Because the store sells the items, refunds and any right to cancel are handled by the store under its terms: Apple at reportaproblem.apple.com, or Google through your Google Play order history. If a purchase is refunded or reversed, we may remove the items it gave you or limit the account until the balance is settled.
- Nothing in these terms affects your legal rights as a consumer, including if something you bought is faulty or not as described.
Your account and progress
You can start as a guest. Online progress is stored on our server, and you may link a sign-in, such as Game Center on iPhone and iPad or Google Play Games on Android, to recover the same island on another device. An unlinked guest account may be unrecoverable if you lose its device access. Older offline progress stays separate from the online island. Deleting your game account permanently removes its progress and unused items, including items you bought.
Online opponents, including friends, can attack buildings and steal coins while you are away. Shields, protected balances and loss limits apply. Your nickname, avatar, stars, island and rank are visible to other players. You can manage friends and block players in the game.
Names and conduct
Other players see your game name, so keep it friendly. Don't choose a name that:
- is offensive, hateful, sexual, violent or threatening;
- pretends to be someone else, including us or another player;
- contains personal information, such as a real full name, phone number or address, yours or anyone else's;
- advertises something or breaks the law.
Treat other players fairly: don't harass anyone, report players falsely or try to get around a block. The game checks names automatically and refuses ones that break these rules, and you can change your name a few times a day. We may change a name that breaks these rules without notice, and while a reported name is being reviewed it is shown as a default name. To report a player or a name, use the ••• button next to them in the game, or see Report a player.
Fair play
Please don't cheat, use bots, modify the game, exploit bugs, interfere with our servers or try to get items you haven't earned or paid for. If you do, we may remove the items involved.
Suspending or closing an account
You can stop playing at any time, and delete your account in Settings. We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires it. Unless the law prevents it, we'll tell you why, and you can contact us if you think we've made a mistake.
The game itself
We work hard to keep the game running, but it's provided “as is”, and we can't promise it will always be available or free of errors. We may update, change or eventually stop running the game. If we ever plan to close it, we'll give reasonable notice in the game. Nothing in these terms limits liability that the law doesn't allow us to limit, such as for death or personal injury caused by negligence, or for fraud. Your statutory rights as a consumer aren't affected.
Changes to these terms
We may update these terms. We'll change the date at the top, and if the change is significant we'll tell you in the game before it applies. If you keep playing after a change, the new terms apply; if you don't agree, you can stop playing and delete your account.
Law
These terms are governed by the laws of England and Wales. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts.
General
If a court decides that part of these terms can't be enforced, the rest still applies. If we don't enforce a right straight away, we can still enforce it later. These terms, your store's terms and our Privacy Policy are the whole agreement between you and us about the game. We may transfer our rights and duties under these terms to another organisation that takes over the game; your rights under them won't be reduced as a result.
